Overview

YARMO CHARM is operated by YARMO COMMERCE LIMITED. Throughout these Terms of Service (the “Terms”), “YARMO CHARM,” “we,” “us,” and “our” refer to YARMO COMMERCE LIMITED, trading as YARMO CHARM. We offer this website, including all information, content, features, tools, products, and services available through it (collectively, the “Services”), to you conditioned upon your acceptance of these Terms and the policies referenced in them.

By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services. These Terms apply to all users of the Services, including browsers, customers, and contributors of content.

Our store is hosted by Shopify. Shopify provides the ecommerce platform that enables us to offer the Services, but YARMO COMMERCE LIMITED, trading as YARMO CHARM, is the seller of the products offered through this store.

1. Eligibility and Accounts

You must be at least the age of majority in your place of residence, or use the Services only with the involvement and consent of a parent or legal guardian. You may not use the Services for any unlawful or unauthorized purpose.

If you create an account, you are responsible for providing accurate and current information, maintaining the confidentiality of your login credentials, and all activity under your account. Please notify us promptly at hello@yarmocharm.com if you believe your account has been accessed without authorization. We may suspend or terminate an account where reasonably necessary to protect the Services, our customers, or our legal rights.

2. Products and Product Information

We make reasonable efforts to present product descriptions, colors, finishes, dimensions, materials, and images accurately. Your screen settings and lighting conditions can affect how colors appear. Natural, marbled, patterned, plated, handmade, or molded components may show reasonable variation between pieces. Such variation is not necessarily a defect.

All product descriptions and prices may be corrected or updated when necessary. Products may be available only in limited quantities and may be withdrawn without notice. We reserve the right to limit sales by person, household, geographic region, or jurisdiction where reasonably necessary and permitted by law.

3. Hair Accessory Use and Care

Our products are fashion hair accessories and are not toys. Some products contain small parts, pointed elements, hinges, springs, or metal components. Keep them away from babies, young children, and pets. Use each product only for its intended styling purpose and follow any care guidance shown on the product page.

Inspect an accessory before use. Do not force a hinge, bend a rigid component, overstretch an elastic, or use an item that is broken, cracked, loose, or has a sharp damaged edge. Stop using a product if it becomes damaged or causes discomfort. Individual comfort, hold, and fit vary by hair density, texture, length, and styling method.

4. Orders and Acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not by itself mean that we have accepted the order. We accept an order when we dispatch it or otherwise expressly confirm acceptance.

We may reject, cancel, or limit an order before dispatch for legitimate reasons, including suspected fraud, payment authorization failure, pricing or inventory error, inability to ship to the supplied address, violation of these Terms, or legal restrictions. If we cancel an order after payment has been captured, we will refund the amount charged for the cancelled portion to the original payment method.

You are responsible for reviewing your order, delivery address, contact details, and selected shipping method before submitting payment. Contact us promptly if you notice an error. We cannot guarantee a change or cancellation after processing has begun.

5. Prices, Payments, Taxes, and Duties

Unless otherwise stated, prices are displayed in U.S. dollars (USD). Prices, promotions, and availability may change before an order is submitted. The price charged is the price shown at checkout, subject to correction of an obvious error as permitted by law.

You agree to provide current, complete, and accurate billing and payment information. Payments are processed by Shopify and other payment providers made available at checkout. Your use of a payment method may also be governed by the provider’s terms.

Applicable taxes, duties, shipping charges, and other fees will be shown at checkout when available. Any additional import charge assessed by a destination authority remains the customer’s responsibility unless checkout expressly states otherwise.

6. Shipping and Delivery

We currently ship orders to addresses in the United States, Canada, the United Kingdom, Australia, and New Zealand. Available destinations, shipping methods, charges, and estimates are shown at checkout and described in our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates, not guarantees. Delays may occur because of carriers, weather, public holidays, customs, inaccurate address information, or events outside our reasonable control. Risk of loss and title pass as provided by applicable law. Nothing in these Terms limits any mandatory rights you may have for goods lost or damaged in transit.

7. Returns, Refunds, and Cancellations

Returns, refunds, defective or incorrect items, and order cancellation requests are governed by our Refund Policy, which forms part of these Terms. Please review that policy before purchasing. Nothing in these Terms or our Refund Policy excludes any return, refund, replacement, or cancellation right that cannot lawfully be excluded.

8. Promotions, Discount Codes, and Gift Cards

Promotions and discount codes may be subject to separate conditions, eligibility limits, dates, exclusions, or minimum order values. Unless stated otherwise, offers cannot be combined, applied retroactively, redeemed for cash, or transferred. We may correct or cancel a promotion affected by fraud, technical error, or misuse, subject to applicable law.

Gift cards, if offered, are governed by the conditions presented at purchase and applicable law. Gift cards are not bank accounts or payment cards and may not be resold or used for unauthorized commercial activity.

9. Intellectual Property

The Services and their content—including our brand name, logos, designs, product photography, graphics, copy, page layouts, and software—are owned by or licensed to YARMO CHARM and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Services for lawful personal shopping purposes.

You may not copy, reproduce, republish, distribute, modify, sell, exploit, scrape, or create derivative works from the Services or their content without our prior written permission, except to the extent such restriction is prohibited by law.

10. Acceptable Use

You must not use the Services to:

• violate any law, regulation, court order, or third-party right;
• submit false, misleading, fraudulent, abusive, harassing, defamatory, or unlawful content;
• transmit malware, harmful code, spam, or automated requests that interfere with the Services;
• probe, bypass, disable, or circumvent security, access controls, purchase limits, or fraud-prevention measures;
• collect personal information about others without authorization;
• impersonate another person or misrepresent your identity or affiliation; or
• use the Services for unauthorized resale or other commercial exploitation.

We may restrict access or cancel affected transactions when we reasonably believe this section has been violated.

11. Reviews, Feedback, and Other Submissions

If you voluntarily submit a review, photograph, comment, suggestion, or other content to us, you confirm that you have the right to provide it and that it does not violate any law or third-party right. You retain ownership of your content, but grant YARMO CHARM a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, display, adapt, and use it for operating, improving, and promoting the Services, subject to our Privacy Policy.

We may moderate or remove submissions that are unlawful, misleading, offensive, infringing, unrelated, or otherwise inconsistent with these Terms. We are not required to publish every submission.

12. Third-Party Services and Links

The Services may include tools, payment services, integrations, or links provided by third parties. We do not control third-party websites or services and are not responsible for their content, availability, security, or practices. Your use of them is governed by the applicable third party’s terms and privacy notice.

A third-party link does not necessarily imply endorsement. Please review the relevant third-party terms before completing a transaction or providing information outside our Services.

13. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that information may be processed by Shopify and our service providers as described in that policy.

You agree that we may provide order confirmations, receipts, notices, and other transactional communications electronically. Marketing messages are sent only as permitted by law, and you may unsubscribe using the method included in the message.

14. Errors, Omissions, and Service Changes

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product information, pricing, promotions, shipping, availability, or other content. We may correct an error and update information at any time. If an error materially affects an order already placed, we will contact you and provide the options required by applicable law.

We may modify, suspend, or discontinue all or part of the Services for operational, security, legal, or business reasons. Where required by law, we will provide appropriate notice.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not promise that the website will always be uninterrupted, secure, or error-free. Product warranties, if any, are limited to those expressly stated by us or required by law.

Nothing in these Terms excludes or limits statutory guarantees, warranties, or consumer rights that cannot lawfully be excluded or limited.

16. Limitation of Liability

To the fullest extent permitted by law, YARMO CHARM and its owners, affiliates, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or opportunity, arising from or relating to the Services or products.

Where liability cannot be excluded, our aggregate liability for a claim relating to a product or order will not exceed the amount you paid for the product or order giving rise to the claim, except where a different remedy or amount is required by applicable law.

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence where such liability cannot be limited, or any other liability that applicable law does not permit us to exclude or limit.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless YARMO CHARM and its affiliates, personnel, and service providers from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person’s rights. This section does not require you to indemnify us for our own negligence, breach, or unlawful conduct.

18. Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, epidemic, war, civil unrest, government action, labor disruption, transportation or carrier interruption, utility or network failure, or supplier disruption. This section does not affect rights or remedies that applicable law requires us to provide.

19. Governing Law and Disputes

These Terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Subject to any mandatory right you have to bring a claim elsewhere, the courts of Hong Kong will have jurisdiction.

Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the issue. If you are a consumer, this section does not deprive you of any mandatory protection or forum available under the law of your place of residence.

20. Severability, Waiver, and Assignment

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of that provision.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, reorganization, sale of assets, or transfer of the business, subject to applicable law.

21. Entire Agreement

These Terms, together with the policies and notices expressly incorporated by reference, form the entire agreement between you and YARMO CHARM regarding the Services and supersede prior discussions or communications concerning the same subject. If these Terms conflict with our Privacy Policy on the handling of personal information, the Privacy Policy controls for that issue. If a specific promotion or product has additional written terms, those additional terms control only for that promotion or product.

22. Changes to These Terms

We may update these Terms to reflect changes to the Services, our practices, or legal requirements. The revised version will be posted on this page with an updated “Last updated” date. Where required by law, we will provide additional notice or request consent. Your continued use of the Services after the revised Terms take effect constitutes acceptance to the extent permitted by law.
